Terms of Service

1. Introduction

These Terms of Service (“Agreement”) govern your access to and use of services provided by Noteway (“Company,” “we,” “us,” or “our”) through noteway.net and related systems. By creating an account, purchasing services, or using our platform, you agree to be bound by these Terms.

If you do not agree with these Terms, you must not use our services.


2. Lawful Use

You agree to use Noteway’s services only for lawful purposes. You may not use the service to store, transmit, or distribute material that:

  • Violates any applicable local, state, federal, or international law
  • Infringes intellectual property rights
  • Is fraudulent, deceptive, or misleading
  • Promotes illegal activity
  • Contains malicious software or harmful code

You are solely responsible for all content transmitted through your account.


3. Acceptable Email Use

Noteway provides hosted email services intended for legitimate, person-to-person communication.

The following activities are strictly prohibited:

  • Sending unsolicited bulk email (spam)
  • Purchasing or using email lists without verified opt-in
  • Email marketing campaigns or promotional blasts
  • Use of automated “warmup” tools or mass-mailing services
  • High-volume email forwarding designed to bypass sending limits
  • Impersonation or spoofing of domains you do not control

We reserve sole discretion to determine whether email activity violates this policy.


4. Domain & DNS Requirements

Customers using custom domains must maintain proper DNS configuration, including:

  • Valid MX records
  • SPF records
  • Recommended DKIM and DMARC records

Improper DNS configuration that results in service abuse, reputation damage, or deliverability harm may lead to service suspension.


5. Sending Limits

To protect platform reputation and service stability, outbound email limits apply. Standard accounts may be limited to a defined number of messages per hour or per day.

Excessive or abnormal sending behavior may result in:

  • Temporary rate limiting
  • Suspension of outbound mail
  • Account termination

6. Human-Focused Communication

Noteway services are intended for communication between humans. Automated bulk transmissions, high-frequency transactional streams without prior approval, or system-generated spam-like activity are prohibited.


7. Account Responsibility

You are responsible for:

  • All activity under your account
  • Maintaining secure passwords
  • Ensuring authorized access only
  • Monitoring sub-accounts or user accounts under your plan

We are not liable for unauthorized use resulting from your failure to secure your credentials.


8. Resource Usage

You may not use the service in a way that:

  • Consumes excessive server resources
  • Disrupts other customers
  • Interferes with infrastructure stability

Accounts causing service degradation may be limited or terminated without refund.


9. Support Conduct

We expect respectful communication with our support team. Abusive, threatening, or harassing behavior — including chargeback threats without prior dispute resolution attempts — may result in immediate termination of service.


10. Billing & Payments

  • Services must be paid in advance.
  • Failure to pay by the due date may result in suspension.
  • No prorated refunds are provided for mid-cycle cancellations.
  • Chargebacks initiated without contacting support may result in account termination and recovery fees.

All fees are non-refundable unless explicitly stated otherwise.


11. Cancellation

Customers may cancel at any time through their account portal. Cancellation:

  • Does not entitle you to partial refunds
  • May take up to 72 hours to process
  • Results in permanent deletion of account data after the retention period

You are responsible for backing up your data before cancellation.


12. Backups & Data Loss

We may perform periodic backups as a courtesy; however:

  • Backups are not guaranteed
  • We do not guarantee data restoration
  • You are responsible for maintaining independent backups

Noteway is not liable for lost data, corrupted data, or service interruptions.


13. Suspension & Termination

We reserve the right to suspend or terminate accounts:

  • For violations of these Terms
  • To protect infrastructure or reputation
  • For abuse complaints or spam reports
  • At our sole discretion, with or without notice

Termination may result in permanent data loss.


14. Limitation of Liability

To the fullest extent permitted by law:

  • Noteway is not liable for indirect, incidental, or consequential damages
  • We are not responsible for lost profits, lost data, or service downtime
  • Our total liability shall not exceed the amount paid for services during the previous billing cycle

15. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted access. Maintenance, outages, or third-party infrastructure failures may occur.

Any uptime representations are goals, not guarantees, unless explicitly stated in a separate Service Level Agreement (SLA).


16. Changes to Terms

We may update these Terms at any time. Changes become effective upon posting to noteway.net.

Continued use of services after changes constitutes acceptance of the revised Terms.
